TERMS OF BUSINESS AND FEE INFORMATION

Introduction

The Partners wish all our clients to understand fully the basis upon which the firm conducts its business and will charge for the work done. These terms of business will apply. Please read them carefully and raise any aspect upon which you require further information with the person who has the conduct of your work.

Charge by reference to Time Spent

We keep a record of the time spent by our partners, detectives and their assistants ("fee earners") upon client's business. You will be advised at the beginning of the matter of the charge per hour of the fee earners who are likely to work on your matter. The charge per hour notified is the basic rate. The quoted hourly rate may be increased by up to 25% where this is justified to reflect the value of the matter, its complexity or difficulty, the degree of urgency and like matters. Hours recorded are divided into ten six minute units (a letter or a short telephone call is recorded as one unit).

We review our charging rates, usually annually, to reflect the cost of providing legal services We will let you know when there is any change in the rate applicable to any matter in progress for you.

Detectives costs are the subject of statutory provision. In contentious matters (business before a Court) a detectives fees may be the subject of taxation; that is a review by the taxing officer.

Assessment of Charges at the Outset

Some work, in which the time to be spent can be predicted with confidence, can be the subject of a fixed quotation. In many types of work we are able to give an estimate of the cost of the job, based upon the information known at the outset. If circumstances change resulting in additional work that could not have been foreseen, we will agree with you the basis of charge for the additional work.

Terms of Business

Payment on account: We reserve the right to invoice you quarterly, that is on the 1st January, 1st April, 1st July and 1st October for the value of the recorded time to date. We will not usually issue interim invoices if the matter is likely to be concluded within the next two months.

Disbursements: These are fees we pay to third parties for such matters as searches, experts reports, registration fees. We reserve the right to ask you to fund proper disbursements incurred or to be incurred in connection with the clients affairs, as and when they arise.

Payment: Accounts delivered are payable within 28 days of receipt and if the account is not paid within that period we reserve the right to charge interest on all overdue amounts at 8% above Barclays Bank base lending rate for the time being, calculated daily from the invoice date.

In matters in which we hold monies due to you we reserve the right to retain monies with which to pay accounts delivered and to account to you for the balance.

Termination of Retainer: If these terms of business are not complied with we reserve the right to suspend work on the your file and any other current file and /or withdraw from the retainer.

Personal Responsibility For Costs

We are obliged by professional rules to inform our clients in contentious matters:-

i) they will remain personally responsible for their solicitors costs regardless of any Order made for costs against an opponent.
ii) of the probability that if they lose they will have to pay their opponents costs as well as their own.
iii) that if they win an Order for costs against their opponent is not likely to cover all their costs incurred with their own solicitor and their opponent may not be capable of paying what he has been ordered to pay.
iv) if their opponent is legally aided they are unlikely to be entitled to enforce an Order for costs made against him.

Complaints

It is the intention of the partners at Hides Detective Agency that our clients receive the best possible service. We regard it as essential therefore that if a client is dissatisfied the partnership should learn of that dissatisfaction in order to be able to take any possible remedial step.

If you have any reason to be unhappy with the work carried out on your behalf you must raise the matter immediately with the person carrying out the work. If the matter is not resolved to your satisfaction or if you feel unable to raise it with the fee earner who is dealing with the matter then you must raise the matter with a senior member of the firm.

All work carried out by a London fee earner should be referred to either Mr. M Christian or Mr. R. Goulding at the London office (Central) (0845-020-4288) All work carried out in the Norwich office should please be referred to Mr. Nicholson (0845-020-4288.

The senior member of the firm you contact will listen to the circumstances and agree with you the action that is to be taken. He will then investigate the matter and will write to you with an explanation as to what action can be taken. If we cannot satisfy you in this way there are other courses available to you upon which you will need to take advice from an independent solicitor. We hope this procedure will contribute towards the high level of service we endeavour to supply to the client.
